Our Anti-Kickback procedures are designed to promote integrity and fairness in government contracting by prohibiting improper financial incentives. Specifically, it is illegal for contractors or subcontractors involved in federally funded projects to offer, solicit, provide, or accept any form of “kickback”. Examples of a kickback include

  • Or anything of value

Kickbacks are offered in exchange for favorable treatment in the awarding or performance of a contract or subcontract. This Act is designed to prevent corruption, inflated, costs and unethical practices that undermine public trust and the effective use of federal funds. 

Anti-Kickback Act of 1986 (41 U.S.C. 51-58)

The  prohibits offering, giving, soliciting, or receiving anything of value to improperly influence decisions related to federally funded projects or contracts. Its purpose is to ensure that procurement and research decisions are made based on merit, quality, and cost and not personal gain. This law applies broadly and covers interactions with federal agencies, contractors, vendors, subrecipients, and research partners. Violations of this Act may result in criminal penalties, civil fines, termination of awards, and debarment from future funding.
